These Terms and Conditions (the "Terms") govern your access to and use of americanprobp.com (the "Site"), operated by American Pro Building Products, a brand of Patwin Plastics, Inc. ("American Pro," "we," "us," or "our"). By accessing or using the Site, submitting a form, or requesting information, samples, or a quote, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Use of the Site

You may use the Site for lawful purposes only and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. You agree not to:

• Use the Site in any manner that could disable, overburden, damage, or impair it, or interfere with any other party's use of the Site
• Attempt to gain unauthorized access to the Site, our servers, or any connected systems or networks
• Use any automated means to access the Site or collect information from it without our prior written permission
• Submit false, misleading, or fraudulent information through any form on the Site

Product information and availability

We work to keep product descriptions, specifications, colors, and other information on the Site accurate and current. Even so, we do not warrant that all content is complete, error-free, or up to date at all times. Color representations of decking, porch flooring, and trim shown on screen are approximate and may differ from actual product due to display settings, lighting, and manufacturing variation. We recommend requesting physical samples before making a final color or product decision. Product availability, specifications, and offerings may change without notice.

Quotes and samples

Requests for quotes, samples, or product information submitted through the Site are requests only and do not create a binding offer or contract. Any quote we provide is an estimate based on the information available at the time and may be subject to change, verification, and product availability. Pricing and purchasing are generally handled through our distributors and dealers. Nothing on the Site constitutes an offer to sell at a stated price.

Warranty

American Pro products, including TrueGrain Deck™, may be covered by a limited written warranty. Any applicable warranty, including its coverage, conditions, exclusions, and the steps required to make a claim, is set out in the separate warranty document for the relevant product. Statements on the Site about warranty length or coverage are summaries only and are qualified in full by that written warranty. Except as expressly stated in the written warranty, the Site and its content are provided without warranties of any kind.

Intellectual property

The Site and its contents, including text, graphics, logos, product names, photographs, renderings, diagrams, videos, and the overall design, are owned by or licensed to American Pro Building Products and Patwin Plastics, Inc., and are protected by copyright, trademark, and other intellectual property laws. "American Pro," "TrueGrain Deck," "InvisiClip," and related marks, names, and logos are our trademarks. You may not copy, reproduce, republish, distribute, modify, or create derivative works from any part of the Site without our prior written consent, except that you may view and print pages for your own non-commercial reference.

Third-party links and services

The Site may contain links to third-party websites and services, including our deck visualizer, distributor and dealer sites, social media pages, and affiliated brand sites, as well as tools provided by service partners. These third parties operate independently, and we do not control and are not responsible for their content, products, services, or practices. Following a link to a third-party site is at your own risk and subject to that third party's terms and policies.

Disclaimer of warranties

The Site and all content, information, and materials provided through it are offered on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, with respect to the Site itself. We do not warrant that the Site will be uninterrupted, secure, or free of errors or harmful components. This disclaimer applies to the Site and does not limit any separate written product warranty.

Limitation of liability

To the fullest extent permitted by law, American Pro Building Products and Patwin Plastics, Inc., and their owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to use, the Site, even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless American Pro Building Products and Patwin Plastics, Inc., and their owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your misuse of the Site or your violation of these Terms.

Governing law

These Terms and any dispute arising out of or relating to the Site are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. You agree that any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Site after changes are posted means you accept the updated Terms.
